LEGAL BASES OF DRAWS ORGANIZED BY IGZAR HOLDINGS CORP. (BMC LATINA) OF SOCIAL NETWORKS

 

First.- ORGANIZING COMPANY, OBJECT, DATES AND SCOPE

The organization of the promotional raffle is promoted by the company Igzar Holdings Corp. - (hereinafter, “Igzar Holdings Corp.”), owner of the BMC Latina brand (hereinafter BMC Latina), with address in Guachipelin de Escazú.

BMC Latina organizes, for promotional purposes of its BMC brand, different modalities of draws through Social Networks (hereinafter, "the Draw" or "the Promotion") at a national level, to be developed through the Internet, whose participation is open to participants over 18 years of age and residents of Costa Rica.

The exact start and end dates of the Promotion will be announced by BMC Costa Rica on Facebook, Instagram, official website (www.bmc-latina.com), email or other RRSS sufficiently in advance of the start of it.

 

Second.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

All those people (hereinafter, “the Participants”) who are over 18 years of age, residents of Costa Rica, who have a valid profile on the social network, may participate in this Promotion.

BMC Latina will organize different types of raffles whose participation mechanics may consist of the following:

• Data update: through the form sent by email the participant must complete it.

• Registration for an event or challenge: the participant must complete the form requested on the website.

• Other modalities explained in a Landing Page or social networks provided by BMC Latina.

After meeting the detailed requirements, Participants will enter to participate in the corresponding Draw.

 

Third.- PRIZES, CONDITIONS OF THE PROMOTION AND METHOD OF EXCHANGE

Once the participation period established by BMC Latina has elapsed, a person will be randomly selected through the Number generator or any other random system from among all the Participants who have met the promotion requirements.

The number of winners resulting from this Promotion will be established by BMC Latina in its social media account, email or Landing Page.

The prize that will be delivered to the Winner or Winners will consist of what is announced in the post or Landing Page of the Draw by BMC Latina. 

When BMC Latina chooses the person or persons who win the Draw, it will communicate it directly to the social network account or through WhatsApp from the day after the Winner is known. 

The Winner must contact BMC Latina by Direct Message or email before the expiration period expires (72h), otherwise they will not be able to obtain the prize. If the winner does not appear, BMC Latina reserves the right to declare the prize void or draw a new winner.

Once the required shipping information is provided, BMC Latina will indicate the withdrawal of the prize at the agreed address within a period of 30 calendar days. In the event that the winning person cannot be present to collect the prize, they may send an authorized person with prior notification to BMC Latina. The promotion prize can only be physically withdrawn and can be sent to another place other than the one indicated. (Shipping by courier, Costa Rica mail, parcels, etc.)

 

Fourth.- GENERAL LIMITATIONS ON PARTICIPATION.

The following persons may not participate in the Draw: (i) Individuals who participate directly or indirectly in the capital of BMC Latina, (ii) the Notary designated for the notarization of these bases, nor any of the employees of said Notary, (iii) Any other natural person who has directly or indirectly participated in this Promotion or has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).

By accepting these Legal Bases, Participants consent to BMC Latina excluding or disqualifying these entries from the Sweepstakes.

Those participations that have been made after the end date of the Promotion, as well as those that do not meet the requirements established in the second section of these Legal Bases, will be considered void. BMC Latina reserves the right to exclude from the Promotion those Participants that it suspects or detects that they have participated in any fraudulent manner.

In addition, BMC Latina reserves the right to eliminate from the Sweepstakes those Participants who include offensive comments in their responses and/or that violate the rights of BMC Latina, and who have created multiple accounts to participate in this Promotion.

If it is evident that any of the Winners do not meet the requirements set forth in the Bases, or do not prove what was requested of them, their participation will be considered void and they will be automatically excluded from the Promotion, losing all rights to the prize awarded by virtue of this Draw.

The prize awarded will not be subject to changes, alterations or compensation at the request of any of the Winners, and cannot be exchanged for any other product or for money. BMC Latina reserves the right, if there is just cause and prior legal communication, to make any change, suspend or extend this Promotion.

A period of FIFTEEN (15) calendar days is established from the date of awarding the prize, to make any claim motivated by this Promotion. It is hereby recorded that the Participants do not have to pay, as a consequence of the proposed Draw, any additional amount to BMC Latina.

BMC Latina reserves, if necessary, the right to replace the prizes with others of similar characteristics.

 

Fifth.- LIMITATIONS ON THE CONTENT OF THE POST

Both the participation and the posts published by the Participants under this promotion will be subject to the following limitations:

• Participation in this Promotion, as well as the publication of the posts by the Participants may not under any circumstances violate the Rules of the social network used or the Conditions of the service of the social network used.

• The post or story must not infringe the intellectual and industrial property rights of third parties or any other property rights of third parties.

• The post or story may not include any of the following content:

  • Discrimination: In no case may the post or story be published with an intention that intends to discriminate against third parties and that violates the principles of the right to honor, personal and family privacy, self-image and dignity of the person. Any type of discriminatory content is prohibited, whether for reasons of race, sex, religion, opinion, nationality, disability or any other personal or social circumstance.

  • Illegal Activities: The post or story may not include content that promotes illegal activities or that incorporates obscene or defamatory content.

  • Self-destructive content: It is prohibited for the post or story to include content that promotes the use of narcotic substances or that could incite eating disorders and self-harm.

  • Violence: It is expressly prohibited to participate with a post or story that promotes violence and/or includes, without limitation, sexual violence or violence against animals and people.

  • Degrading content: Those posts or stories that are intimidating, threatening, degrading or that in any way promote violence against a person or a specific group are not allowed.

  • Sexual Content: It is expressly prohibited for the post or story to incorporate sexual content.

• In the event that it is proven that any of the Draw Participants incurred in any of the limitations established in this section, BMC Latina reserves the right to exclude said Participant from this Promotion.

 

Sixth.- EXCLUSION OF LIABILITY.

By way of example and not limitation, BMC Latina is not responsible for the following circumstances:

• If you do not correctly follow the participation requirements established in the second section of these Legal Bases.

• The use that the people who are winners make regarding the prize that is the object of this Promotion.

• The content that the Participants include in the post or the story published in their accounts of the appropriate Social Network and the infractions that this post or story could commit (falsifications, violation of intellectual property rights, inappropriate content).

• Damages of any kind that may be due to the temporary lack of availability or continuity of the operation of telecommunications networks.

• Of the incidents caused by the lack of due diligence on the part of the Participant or by the improper use of the social network.

• Of the cases of force majeure or fortuitous event that could prevent the realization of the Draw or the total or partial enjoyment of its prize. In the event that this Promotion could not be carried out, either due to fraud detected in it, technical errors, or any other reason that is not under the control of BMC Latina and that affects the normal development of the Draw, BMC Latina reserves the right to cancel, modify, or suspend it.

 

Seventh.- ASSIGNMENT OF RIGHTS

• By accepting these Legal Bases, the Participants and the winners expressly agree to assign to BMC Latina a Publication License on the content of the posts or stories with which they participate in this Promotion, with which they authorize BMC Latina to publish them in full. free, worldwide, for the maximum period of time permitted by law and without any restriction or reservation.

• By virtue of this License, the Participants accept that the posts or stories with which they participate in the raffle may be used in any opportunity, both promotional and commercial, by decision of BMC Latina.

• In the same way, the Participant accepts that BMC Latina may use the content of the post or story with which they have participated, to quote it and associate it with their pseudonym or with their name in the profile of social networks and other social networks, in their promotional operations. , marketing and advertising. The Participants expressly state that any post or story they send to BMC Latina through the social network effectively belongs to each Participant or has the authorization of the legitimate owners or licensees of the content and does not infringe the intellectual or industrial property rights of third parties or any other proprietary rights of third parties.

• The Participants guarantee to BMC Latina that they have all the faculties and powers necessary to agree to the rights assigned hereby and declare that the posts or stories sent to BMC Latina are completely original.

• The Participant acknowledges having been informed that BMC Latina rejects all types of responsibility regarding the exploitation or dissemination of the posts or stories sent by the Participants in any medium.

• The chosen social network (Instagram, Facebook, WhatsApp, Strava or another not mentioned) does not sponsor, endorse or administer this Promotion in any way, nor is it associated with it. The actions carried out for participation in this Promotion are carried out in favor of BMC Latina and not for the benefit of the social network.

 

Eighth.- PROTECTION OF PERSONAL DATA

• BMC Latina takes the protection of your privacy and personal data very seriously. Therefore, your personal information is kept secure and treated with the utmost care.

• In accordance with the provisions of the Privacy Policy located at the bottom of our website www.bmc-latina.com, each Participant with the acceptance of these legal bases consents that the personal data provided to BMC Latina be incorporated into a file owned by BMC Latina.

• Specifically, BMC Latina will use your personal data to process your participation as a Participant and to notify you of the prize in the event that you are the winner, as well as to send you information about products and promotions related to Igzar Holdings Corp. and its associated brands.

• Likewise, BMC Latina will use your data to send you Newsletters and commercial and promotional communications related to the products of Igzar Holdings Corp. and its associated brands by letter, telephone, email, SMS/MMS, or by other means of electronic communication.

• The Participant guarantees that the personal data provided is true and is responsible for notifying BMC Latina of any changes thereto. The Participant will respond, in any case, for the veracity of the data provided, reserving BMC Latina the right to exclude from the Promotion any Participant who has provided false information, without prejudice to exercising other actions that proceed by Law. It is recommended to have the utmost diligence in terms of Data Protection through the use of security tools, and BMC Latina cannot be held responsible for illegal theft, modification or loss of data.

• You can exercise your rights of Access, Rectification, Cancellation and Opposition by sending an email to info@ridebmc-cr.com

• BMC Latina maintains the security levels of protection of personal data and has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of the data that the Participant provides through the Promotion, without prejudice to informing you that Internet security measures are not impregnable. BMC Latina undertakes to comply with the duty of secrecy and confidentiality regarding the personal data contained in the automated file in accordance with applicable legislation.

 

Ninth.- CHANGES AND ACCEPTANCE

• BMC Latina reserves the right to modify or expand these promotional bases, to the extent that it does not harm or impair the rights of the Participants in the Promotion.

• Participation in the Sweepstakes implies full acceptance of these Legal Bases by the Participants who register for this Promotion, which may be formalized in an Act authorized by a Notary Public and will be available to any person who wishes to consult them.
